General Terms and Conditions of Sale (GTCS)

Article 1 – Legal Information and Scope

These General Terms and Conditions of Sale govern the contractual relationship between Kelly Lefèvre (Ormée), a self-employed sole proprietor with its registered office at Rue de la Grotte 103, 7700 Mouscron, Belgium, and its business address at Rue de Tourcoing 29, 7700 Mouscron, Belgium, registered with the Belgian Crossroads Bank for Enterprises (BCE) under number 1030.137.426, VAT number BE1030.137.426.

(hereinafter referred to as the "Seller"),

and any natural person of legal age purchasing products exclusively for personal use (hereinafter referred to as the "Customer").

By confirming an order, the Customer acknowledges having read and accepted these General Terms and Conditions of Sale.

Article 2 – Products and Availability

The products offered are those displayed on the website at the time of consultation, subject to availability.

Minor variations in product colours resulting from differences in screen displays shall not give rise to any liability on the part of the Seller.

Article 3 – Prices and Payment

All prices are stated in euros (€), inclusive of all applicable taxes (including Belgian VAT).

The total amount payable is displayed before the final confirmation of the order.

Payments are made securely online using the available payment methods (Bancontact and credit card).

Article 4 – Ordering Process

The final order confirmation button is clearly labelled:

"Order with obligation to pay."

A confirmation email is automatically sent once payment has been successfully completed.

Article 5 – Delivery

Delivery is available in Belgium, France, the Netherlands and Luxembourg.

The estimated delivery time is 7 business days, and in any event shall not exceed the maximum legal period of 30 days.

Article 6 – Right of Withdrawal and Returns

In accordance with Article VI.47 of the Belgian Code of Economic Law, the Customer has the right to withdraw from the purchase within 14 calendar days, without providing any reason.

6.1 Withdrawal Period

The withdrawal period expires 14 calendar days after the Customer, or a third party designated by the Customer (other than the carrier), takes physical possession of the goods.

6.2 Notification

The Customer may exercise the right of withdrawal by:

  • email to info@ormee.be;

  • postal mail sent to the Seller's registered office; or

  • using the model withdrawal form provided below.

6.3 Condition of Returned Goods

Returned products must show no signs of damage, wear or alteration and must be returned complete, including all accessories, instructions and original labels.

Where the value of the goods has been diminished due to handling beyond what is necessary to establish their nature, characteristics and functioning, the Seller reserves the right to reduce the refund accordingly or refuse reimbursement where appropriate.

6.4 Return Costs

Return shipping costs are borne exclusively by the Customer.

The Customer remains responsible for selecting the carrier and ensuring proper tracking of the returned parcel.

6.5 Refund

The Seller will reimburse all payments received using the same payment method used for the original transaction, within 14 calendar days following notification of the withdrawal.

6.6 Hygiene and Health Exception

In accordance with Article VI.53(5) of the Belgian Code of Economic Law, the right of withdrawal does not apply to sealed goods that are unsuitable for return for reasons of health protection or hygiene once they have been unsealed.

This includes, but is not limited to:

  • breast pumps;

  • breast shields;

  • nipple protectors;

  • milk storage bags;

  • baby bottles;

  • bottle teats;

  • pacifiers; and

  • any accessories intended to come into direct contact with the skin or breast milk.

Once such products have been unsealed, the right of withdrawal is permanently forfeited, except where a proven technical defect is covered by the statutory legal guarantee.

Article 7 – Statutory Legal Guarantee

In accordance with Articles 1649bis et seq. of the Belgian Civil Code, the Customer benefits from a 2-year statutory legal guarantee for lack of conformity.

Any defect must be reported to the Seller in writing within 2 months of its discovery.

Article 8 – Personal Data Protection (GDPR)

Personal data are processed in accordance with the General Data Protection Regulation (GDPR) and the Belgian Act of 30 July 2018 concerning the protection of natural persons with regard to the processing of personal data.

Article 9 – Governing Law and Dispute Resolution

These General Terms and Conditions are governed by Belgian law.

The Customer may also use the European Commission's Online Dispute Resolution (ODR) platform to resolve disputes.

Failing an amicable settlement, disputes shall be submitted to the competent courts of the Seller's registered office or those of the Customer's place of residence, as provided by applicable law.
